Joseph might not have had sex with her yet, but he could still be referred to as her husband. Even though the Torah mandated death for adultery, it had fallen out of use among the Jews by the time the Romans conquered the Jews (strange isn't it? Yahweh gives the Jews a law and they ignore it because they deem it immoral). Plus if Joseph was really just, the death penalty was supposed to apply to both the man and the woman involved.
